Terms of Service
Last updated: 2026-08-21
These terms are the agreement between you and Adam Dickinson, trading as Kubently, for use of Kubently Cloud at cloud.kubently.io. By creating an account you agree to them. They cover the hosted service only — the open-source Kubently project is licensed separately under Apache 2.0.
1. The service
Kubently Cloud connects to Kubernetes clusters you control and produces diagnoses of their state. You install an executor in your own cluster; we provide the hosted control plane it connects to.
Diagnoses are generated by a large language model and are advisory. They can be incomplete or wrong. You remain responsible for deciding what to do in your infrastructure, and for verifying anything before acting on it. Do not treat a diagnosis as a substitute for your own judgement about a production system.
2. Your account
You must be able to form a contract and, if signing up on behalf of an organization, be authorised to bind it. Keep your credentials, API keys and executor tokens secret; you are responsible for activity under them. Tell us promptly at hello@kubently.io if you believe they have been compromised.
You may only connect clusters you own or are authorised to administer.
3. Acceptable use
You agree not to:
- Connect a cluster you are not authorised to access.
- Attempt to break tenant isolation, or access another customer's data.
- Probe, scan or load-test the service without our written permission — legitimate security research is welcome, see the security page.
- Resell the hosted service, or use it to build a competing hosted product. Self-hosting the open-source project is expressly permitted under its own licence.
- Use the service to break the law, or to circumvent plan limits.
4. Plans, billing and taxes
Free covers 1 cluster and 10 diagnoses per day, at no charge and with no time limit. Team is a flat $49 per month for your workspace, or $480 per year if you pay annually (equivalent to $40 per month). The fee does not depend on how many clusters you connect. Fair use is 200 diagnoses per day per connected cluster, so the allowance grows with your fleet although the fee does not. Enterprise is under a separate written agreement, which prevails over these terms where they differ.
Fees are billed in advance, monthly or annually as you choose, and are exclusive of taxes, which are added where applicable. Connecting or removing a cluster does not change the amount you are charged.
If we change prices we will give existing subscribers at least 30 days' notice by email before the change applies to them.
5. Cancellation and refunds
You can cancel at any time from Plan & billing. Cancellation takes effect at the end of the period you have already paid for; you keep access until then, and are not charged again.
Fees already paid are non-refundable, except that:
- If you cancel within 14 days of your first paid charge, write to hello@kubently.io and we will refund it in full.
- If we materially fail to provide the service for a sustained period, we will refund the affected portion of your fees.
- Where local consumer law gives you a stronger right to a refund, that law applies and these terms do not limit it.
We may suspend or terminate an account for breach of these terms, or for non-payment after notice. If we terminate without cause, we refund the unused portion of any prepaid fees.
6. Your data
Your cluster data is yours. We process it to provide the service, as described in the privacy policy, and we claim no ownership of it. Diagnosis conversations are deleted automatically after 7 days.
You can export your data, and request deletion of your workspace, from Settings → Your data. After a deletion request or termination we delete remaining account data within 30 days, except records we are required to keep for tax or accounting purposes.
7. Availability
We aim to keep the service available continuously, but we do not offer a contractual uptime commitment on the Free or Team plans. Uptime commitments are available under Enterprise agreements. We may perform maintenance that briefly interrupts the service, and will give notice where we reasonably can.
8. Warranties and liability
The service is provided “as is”, without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose and non-infringement.
To the maximum extent permitted by law, neither party is liable for indirect, incidental, special or consequential damages, or for lost profits, revenue or data. Our total liability arising out of or relating to these terms is limited to the amount you paid us in the twelve months before the event giving rise to the claim.
Nothing in these terms excludes liability that cannot lawfully be excluded, including for fraud, or for death or personal injury caused by negligence. If you are a consumer, your statutory rights are unaffected.
9. Changes to these terms
We may update these terms. For material changes we will email account holders at least 30 days before they take effect. Continuing to use the service after that means you accept the new terms; if you do not, cancel before they take effect and we will refund any prepaid fees for the unused period.
10. Governing law and contact
These terms are governed by the laws of the State of Texas, USA, without regard to conflict-of-law rules. If any provision is held unenforceable, the rest remains in effect.
